APPEALS
The Queensland and Australian criminal systems have built-in safeguards against
errors being made by Magistrates and Judges. The system of appeals allows appeals
against conviction and also against sentence. Thorough preparation, coupled with
the briefing of experienced barristers, offers Ellison Moschella & Co’s clients
peace of mind that adverse decisions can be tested fully and reversed where appropriate.
TRAFFIC MATTERS
Ellison Moschella & Co offers effective and successful representation in traffic
matters including representing clients facing traffic charges, whether breaches
of the Road Rules or more serious offences such as drink driving type matters, as
well as in relation to driver licence appeals and applications for reinstatement
of driver licences. Proper preparation for court and representation in court maximises
positive results for our clients.
BAIL APPLICATIONS
Where serious offences are involved, the person charged will often need to apply
to a Supreme Court Judge to be released from custody on bail (with or without conditions).
Provided that the person charged is able to show that there is little or no risk
of re-offending, interfering with witnesses, or failing to appear, the person is
entitled to be released back into the community until the charges are resolved in
the courts. Ellison Moschella & Co provides inhouse advocacy (and access to
experienced barristers if needed) to assist our clients in pursuing these rights.

COMMISSIONS OF INQUIRY / ROYAL COMMISSIONS / CORONIAL INQUESTS
Ellison Moschella & Co’s criminal defence team offers considerable experience
in inquiries, commissions and inquests. Whilst these processes are quite different
from direct criminal defence matters, they are frequently precursors to such prosecutions.
As such, they need to be handled with a great deal of care and with a view to protecting
clients’ interests and safeguarding rights. Contact Ellison Moschella & Co should
such representation be required.
CRIMINAL AND SIMPLE OFFENCES
Ellison Moschella & Co offers its clients a thorough understanding and representation
in police investigations and prosecutions for minor matters (simple offences) and
more serious offences (indictable offences). If you need assistance in any dealings
with the police, call Ellison Moschella & Co.
DOMESTIC VIOLENCE
Domestic violence matters often arise in relation to family breakdowns. (Whilst this is not the only
context in which such applications can arise, it is the most common.) Ellison Moschella
& Co frequently acts for those people who are aggrieved by domestic violence
and require the protection of a court order, and also offers representation to respondents
to such applications. Breaches of Domestic Violence Orders are criminal offences.
Ellison Moschella & Co brings to bear its experience in criminal defence work
to assist those who have been charged with breaches.
