Resumptions

With new roads, tunnels and government infrastructure projects resumptions are more common place.

A resumption doesn't need to be the nightmare that people fear when they first learn their property may be resumed. Ellison Moschella & Co has the expertise and skill to help you recover what you should for the loss of your land.

Whether you are an owner or tenant, you have common law and statutory rights in relation to resumptions of your property, and we recommend that you see us to have those rights explained.

In short, resuming authorities must pay reasonable compensation should your interest in land be affected by a resumption. Resuming authorities will not place your interests ahead of their own.  In our experience a much better result can be acheived by seeking expert assistance.

Most resuming authorities will try to negotiate purchasing a property before formally resuming it. If this happens to you you should seek expert assistance to ensure you are aware of your rights and what you may be entitled to during the negotiation process or ultimately resumption.

In addition to the value of the land resuming authorities are required to pay your legal costs and valuation fees along with other costs which you incur as a result of the reumption. So why wouldn't you get us involved to recover compensation for your property?

Recent changes to the Acquisition of Land Act Qld however have introduced time limits in which you can make a claim so you must act within those limits to ensure you receive compensation.tion.

Please telephone our Ross Moschella on 07 3221 8655 or contact him by email at ross@ellisonmoschella.com.au if you would like to discuss a resumption matter further.
